Terms of Service
For over a decade, we’ve been empowering clients by helping them take control of their financial lives.

1. Objectives

Spotinsights operates as a high-end, privacy-focused investment and savings brokerage service, leveraging proprietary AI-driven analytics to support clients in navigating the digital asset and broader alternative investment landscape. The primary objective is to assist eligible clients in preserving and growing their wealth over the medium and long term through data-informed portfolio construction and ongoing monitoring.

Access to Spotinsights’ services is strictly limited and available only through select proprietary trading firms, family offices, professional intermediaries, and personal referrals. Spotinsights does not offer direct retail onboarding.

2. Activities

2.1 Account creation & onboarding

With the prior consent and cooperation of the client, Spotinsights may assist in the initiation of brokerage, exchange, custodial, or associated accounts required for the implementation of the agreed investment strategy. Clients are furnished with all credentials and instructions to secure and manage their accounts.

At all times, clients remain the full and sole owners of their respective accounts and bear all responsibilities associated with opening, holding, funding, and managing such accounts.

2.2 Asset allocation & AI-assisted portfolio construction

Spotinsights utilizes advanced, proprietary AI models and dynamic quantitative algorithms to propose and, where expressly authorized, implement portfolio allocations and rebalancing decisions. Manual client trades or third-party actions may limit Spotinsights’ ability to monitor, analyze, or report portfolio performance accurately.

2.3 Fund deposits and withdrawals

Clients are solely responsible for the transfer of funds or assets to and from their own accounts. Spotinsights may provide step-by-step guidance but does not execute these actions.

2.4 Account monitoring, AI analytics & reporting

Spotinsights continuously monitors client portfolios via secure integrations and AI-powered analytics. Subject to the plan or mandate, clients receive periodic dashboards summarizing portfolio performance, exposure, risk metrics, and other insights.

3. Fees

3.1 Fee Structure & Variable Fee Model

Spotinsights may assess service fees, performance-related fees, or operational fees depending on the client's engagement level, account configuration, and dashboard activity.

Fees are dynamic and may vary based on:
• Portfolio performance indicators displayed within the client dashboard;
• The volume, frequency, or timing of asset withdrawals or repositioning actions;
• The specific service tier assigned through the client’s referring proprietary trading firm, family office, or intermediary.

Any applicable fees will be made visible directly within the user dashboard along with explanatory notes and, when relevant, estimated projections. Fees may adjust automatically based on performance thresholds, account activity, strategy parameters, or withdrawal progress.

Spotinsights may implement a performance-based fee model whereby fees are accrued or triggered only when certain profit or threshold conditions displayed on the dashboard are met. Fees may be issued periodically or during withdrawal or milestone events, depending on the client’s plan.

By continuing to use the platform and dashboard, the client acknowledges and accepts the permissibility, variability, and conditional nature of the fees displayed.

3.2 Promotions

Spotinsights reserves the right to apply promotional discounts, temporary adjustments, or preferential fee structures. Such promotions may be available only through select partners or referral channels and may be withdrawn or modified at any time.

3.3 Other fees

Spotinsights does not charge hidden or undisclosed internal fees. Clients acknowledge responsibility for all third-party charges levied by exchanges, banks, brokers, or custodians, including transaction fees, withdrawal fees, spreads, or network costs.

4. Security

4.1 Infrastructure

Spotinsights is hosted on institutional-grade cloud infrastructure such as Google Cloud, with encryption in transit and at rest, access controls, and internal security protocols to protect client data and connections.

4.2 Integrations & exchanges

Spotinsights works primarily with reputable brokerage, exchange, and custody partners. Client funds remain in accounts held in the client's own name, and Spotinsights interacts only through client-owned limited-access credentials. Withdrawal permissions are not required and typically not enabled.

5. Disclaimer

5.1 No individualized financial advice

Spotinsights does not provide personalized financial, tax, or legal advice. All guidance and AI-generated outputs are general and informational. Clients should consult qualified independent advisors before making any investment decisions.

5.2 Warranties

Spotinsights disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and uninterrupted service. No guarantee of profitability is made.

5.3 Liability

Spotinsights and its affiliates shall not be liable for indirect, incidental, punitive, or consequential damages of any kind. Total liability shall not exceed the fees actually paid by the client for the services in question.

6. Risks

Investing in digital assets or alternative markets carries significant risks including market volatility, regulatory uncertainty, technological failures, liquidity constraints, and cyber risks. Clients may lose some or all of their invested capital. Risk-management mechanisms such as stop-losses may fail under certain market conditions.

7. Privacy & data protection

Spotinsights complies with GDPR and stores only minimal client data. API credentials are encrypted, and data is never sold or shared with third parties without consent unless legally required. Clients may request deletion of their data subject to regulatory retention obligations.

8. Communication & general terms

By using Spotinsights, the client agrees that:

• They will not hold Spotinsights liable for any trading losses;
• They may discontinue use at any time, subject to settling any outstanding fees;
• All information provided is accurate and updated as needed;
• Spotinsights functions as a non-custodial SaaS platform;
• Clients are responsible for their own tax reporting;
• Dutch law governs this agreement, and disputes are subject to Dutch courts;
• Spotinsights may deny or terminate service at any time for any lawful reason.

Spotinsights is a Securities Dealer registered Worldwide, authorised by the Financial Services Authority (FSA). Disclaimer: Our services relate to complex derivative products which are traded outside and within our exchange.
